The highly-respected automobile Three Guarantees Regulations have been implemented since October 1st, and have played an active role in protecting the legitimate rights and interests of consumers and regulating the auto consumption market.

According to the State Administration of Quality Supervision, Inspection and Quarantine, since the implementation of the Three Guarantees Regulations, China’s automobile Three Guarantees Information has been fully publicized. Up to now, a total of 88 automakers have issued information on the registration of auto three packs. Among them, there are 61 domestically produced cars and 27 imported cars, involving 134 brands, 4,407 models, and 29,868 sales and repair networks.

At the same time, the database of technical consultants was gradually established. According to the data provided by the General Administration of Quality Supervision, Inspection and Quarantine, a total of 20,206 experts from 31 provinces in the country submitted application materials on the Auto Three Guarantees Expert Management System, and 2,369 experts were hired to provide technical consulting support for the dispute resolution of automobile Three Guarantees.

In addition, the work system for dispute resolution in the automobile three packs has been continuously improved. The local consumer associations and quality supervision departments at the local level are gradually in place to handle the dispute handling of auto three packs, and they have begun to accept complaints and inquiries from automobile consumers about auto three packs.

“Quality inspection departments have also found that some auto manufacturers have information disclosure that is not standardized and some auto operators illegally reduce or evade the issue of three packs of responsibility and infringe consumer rights.” Chen Xitong, spokesperson for the General Administration of Quality Supervision, Inspection and Quarantine, was inspected on October 31st. Chen Xitong introduced that, firstly, the information disclosure of some automobile manufacturers is not standardized. On the one hand, there are issues such as missing items and missing items in the contents of individual manufacturers' filing information. For example, 40 automobile manufacturers have incomplete information on the filed models, and 36 automobile manufacturers have incomplete records for the 4S shops. On the other hand, there are still a few automakers that record the three-package voucher that is not standardized. For example, the three-package voucher expressly states that the range of main automobile parts is less than the national standard, and the range of easily-wearable parts and special parts is more than the national standard, “the three main types of Auto Parts and three packs of vehicles,” and so on.

Second, some auto operators set off violation clauses to reduce or exempt Three Guarantees. For example, some automakers added "consumers can only maintain and maintain in the 4S shop, otherwise they do not assume the Three Guarantees responsibility" and other overlord clauses in the escort documents such as the "Maintenance Manual", and some auto 4S shops also in the car purchase contract. Similar "additional conditions" are set to exceed the scope of the Three Guarantees exemption for automobile Three Guarantees and infringe the legitimate rights and interests of consumers.

Third, some "American regulatory vehicles" sellers evade the responsibility of the Three Guarantees. Some "American regulatory vehicle" sellers did not provide three packs of vouchers to users and did not provide any quality guarantees. They tried to circumvent the Three Guarantees responsibilities by means of "signing of undertakings" and "vehicle registration as a company".

"In response to the above problems, the General Administration of Quality Supervision, Inspection and Quality Supervision and Local Quality Supervision Departments will take corresponding measures to effectively promote the implementation of the automobile three-bag package," said Chen Xitong.

He introduced that the AQSIQ and local quality supervision departments at all levels will organize experts to conduct a comprehensive assessment of the integrity and accuracy of information disclosure and disclosure of automobile manufacturers, publish evaluation results, urge information disclosure, and publicize lags in auto production. In accordance with the provisions of the automobile Three Guarantees, the rectification will be completed quickly. At the same time, it will warn the auto manufacturers and sellers who have violated the “Supplemental Conditions” of the three-packet vouchers, the “maintenance and maintenance manual” and the purchase contract, and order them to make correction within a time limit. If the circumstances are serious, they shall be investigated and dealt with according to law.

In addition, it will make full use of information platforms such as automobile Three Guarantees Network, increase the promotion of policies and regulations for automobile Three Guarantees, popularization of auto three packs of professional knowledge, and disclosure of auto three packs of non-compliance information, and explore the establishment of a rapid response mechanism for the Three Guarantees problem. Further improve the auto three packs of expert management mechanism, strengthen contact with third-party agencies such as consumer associations, achieve resource sharing, and jointly play a role in effectively protecting the legitimate rights and interests of consumers.
