China's first environmental protection tax law will be implemented in 2018

Articles 5 and 28 of the full text of the Environmental Protection Tax Law are the general rules, taxation basis and taxable amount, tax reduction, collection management, and supplementary regulations.

The general idea of ​​the environmental protection tax law is to change the “tax” from “fee”, that is, to achieve a smooth transfer of the sewage charge system to the environmental tax system in accordance with the principle of “transfer of tax burden”. The bill will “protect and improve the environment, reduce pollutant emissions, and promote the construction of ecological civilization” into the legislative purpose, and clarify that “enterprise institutions and other production operators that directly discharge taxable pollutants into the environment” as taxpayers, determine air pollution. Matter, water pollutants, solid waste and noise are taxable pollutants.
